The Human Rights Association of Spain (APDHE), feels obliged to transmit our denunciation of human rights violations in the person of Dona Maria Jose Carrascosa, a English citizen, as a result of malfunction of the Administration of Justice and International Cooperation between U.S. and English judicial authorities. The result is the plight in which Ms. Carrascosa is: dam in the United States decreed the seizure of all their property, which is menaced by a penalty payment, etc.
APDHE means that at least in the Western world, if not in a globalized society, it is intolerable that a human being deprived of human rights such as freedom and effective judicial protection. The fact concentrated in a event or competition jurisdictional conflicts between courts of two nations, in this case the United States and Spain, does not justify the courts meet their supposed powers most of judicial authority, that the dignity of persons involuntarily are complicated in such conflicts of jurisdiction and for them unsolvable.
Spain there are final decisions, against which there is no further appeal, should not have to solve later on the same issue, the jurisdiction of New Jersey, should have declined it.
having regard to all legal proceedings that have taken place to date and the resolutions of the same, we concluded in
Exigir la cooperación entre tribunales, acordando la nulidad de la orden de prisión y la inmediata puesta en libertad de Dª. María José Carrascosa a los Juzgados de Nueva Jersey que ordenan, bajo medidas coactivas, que Doña María José Carrascosa, desacate lo ordenado por los jueces españoles, con una clara vulneración del Convenio de La Haya, al que está sometido el propio Tribunal conforme a los Estatutos de la Administración Civil y Criminal de Nueva Jersey, al estar demostrando que el padre jamás ejerció la guarda y custodia de la menor.
Finalmente, de “lege ferenda”, nos permitimos instarle a que, en su condición de Ministro de Asuntos exteriores y de Cooperation, to negotiate a bilateral treaty with the United States of America, for the recognition and enforcement of judgments in civil matters, and especially in relations with parental responsibility, so that we can avoid the existence of future problems by a court and as questions of conflicts of competence.
